Contested Divorce In a contested divorce in Michigan, the spouses have been unable to come to an agreement among themselves regarding one or more of their divorce-related issues, such as child custody, child support, property division, asset distribution, debt allocation, alimony, temporary spousal support and visitation of children. A contested divorce often leads to divorce fight in court, in which the divorce judge will decide the case. 

Uncontested Divorce In an uncontested divorce and often referred to as simple divorces, and the spouses agree on everything and do not need the court to divide assets or make determinations about spousal or child support or custody. The spouses both will have to sign the divorce judgment.  It's simple, fast and inexpensive. 

Alimony In Michigan, each spouse may ask the court for alimony. Alimony cases are generally decided on a case-by-case basis. Not all the cases each spouse may ask the court for alimony. Alimony cases are generally decided on a case-by-case basis. Not all the cases are the same.  Alimony may be awarded in cases where one spouse's earning capacity is significantly lower than the other's. There are different types of spousal maintenance (alimony) that a Michigan family court can award. There is temporary spousal support and there is permanent spousal maintenance. Spousal maintenance is subject to review if the circumstances have changed enough to warrant a change in support. Michigan courts will consider many factors in determining spousal support or alimony.

Child Custody is one of the most hotly litigated issues that can arise during a divorce is child custody and visitation. In Michigan, child custody is determined according to a standard based on the best interests of the child. There are several factors that need to be considered when courts are making custody decisions. The relationship of the parents, the child's relationship with the parents, previous domestic violence, time that each parent can commit to taking care of the child, the amount of time a parent spends at work, age of children. Child Support  In the state of Michigan, the parent with whom the child does not spend a majority of its time will be required to provide a "reasonable support" share of the cost of housing, food, clothing, school, medical treatment and other needs typically provided by Michigan parents.  Generally, the noncustodial parent is required to pay this support to the custodial parent to help cover the child's living expenses. 

Paternity Paternity proceedings are used to legally identify a child’s father. When the identity of a child's father is known, he has certain legal rights and obligations. Our lawyers help unmarried parents establishing paternity and parental rights and obligations. Biological fathers have no legal rights until paternity is established.

Visitation Michigan does not have strict guidelines for visitation schedules. We typically resolve child custody and visitation disputes between the parties through negotiation or mediation. However, if the parties involved cannot fashion a workable parenting plan, we will take the case to court, where we have been extremely successful. 

Modifications When the circumstances in your life substantially change following a divorce or paternity case, you may need to file a motion for a modification of an existing court order in regards to child custody, visitation, child support, or alimony. Those who wish to seek such modifications or those who wish to oppose them will need legal ground for the court to entertain. 

Property Division To finalize your divorce, you will need to reach agreed-upon terms regarding how your marital property, assets, and debts will be divided and distributed. This may be a simple or complex matter where business assets, high net worth, complicated financial histories, extensive real estate, or other investments are involved. 

Contempt When an individual fails to comply with a court order, such as for child support, alimony, or in connection with pending divorce financial matters, or in connection with existing child custody or visitation agreements , he or she may be held in contempt of court. A contempt order from the court may result in legal penalties, such as jail time, orders to pay arrears or other financial consequences, or to comply with custody or visitation terms.
